Terms of Service

  1. 1.Who we are

These Terms are an agreement between TNT Business LLC d/b/a Niktrix, a Florida limited liability company based in Miami, Florida ("Niktrix", "we", "us"), and the business that uses our services ("the venue", "you"). They also cover anyone who visits niktrix.org.

If you accept these Terms for a business, you confirm that you may bind that business. If you have a signed agreement or an accepted quote with us, it applies together with these Terms; where they differ, the signed agreement or quote wins.

  2. 2.What we provide

Depending on what you order, we provide:

    • Self-order kiosk software: your menu on a kiosk, where guests choose items and options and place an order.
    • The Orders screen: your staff see and manage orders on a phone or tablet, signed in with a PIN.
    • The owner’s app: you edit your menu, prices and sold-out items, and can draft a menu from a photo of your printed menu.
    • Review stands: a stand guests tap or scan to open your Google review page. We count the taps and send you the numbers.
    • Installation and training at your counter in Miami-Dade County (Broward by arrangement).

We describe what each product does on niktrix.org and in your quote. We may improve, change or stop a feature; if we stop one you pay for, we tell you first.

  3. 3.Quotes, fees and payment

We quote after we have seen your counter. The quote lists the hardware, installation, training and any monthly fee. Half of the quoted total is due to order the hardware, and the rest when it works at your counter, unless the quote says otherwise.

Monthly fees are billed each month in advance. You can cancel at any time: charges stop at the end of the month you have already paid for, and there are no partial refunds. See our Refund & Cancellation Policy.

Prices do not include sales tax unless the quote says so.

  4. 4.Card payments (when enabled for your venue)

Card payments are not available to every venue. When card payments are enabled for your venue, these terms apply:

    • Payments are processed by Stripe, Inc. through Stripe Connect. You open your own Stripe account and accept the Stripe Services Agreement with Stripe. Your Stripe account is yours, and its terms are between you and Stripe.
    • Money from your guests is paid into your Stripe account, and Stripe pays it out to your bank on its own schedule.
    • You pay 2.99% + 15¢ per payment for cards issued in the United States, and more for international cards. This total includes Stripe’s processing fee and our platform fee. Stripe collects both from each payment.
    • You are responsible for refunds to your guests, chargebacks and disputes, your prices and taxes, and following the card networks’ rules and Stripe’s terms.
    • We never receive or store card numbers. Stripe handles them.
    • We may pause card payments for your venue if we see signs of fraud or misuse, or if Stripe asks us to.
  5. 5.Hardware

Hardware you buy from us belongs to you. Hardware we give you at no charge to use with our service (for example, a card reader) stays ours: it is lent to you, and you return it in working order within 14 days after the service ends. Your quote or agreement says which applies to each item.

  6. 6.Warranty

Hardware we supply has a 12-month warranty from installation. If it fails under normal use, we repair or replace it, at our choice. The warranty does not cover damage, misuse, accidents, liquids, changes made by someone other than us, or normal wear.

On products with a monthly fee, we bring replacement hardware while yours is repaired, when available.

  7. 7.Your responsibilities

    • Give us accurate information and keep your contact details current.
    • Check your menu, prices, tax rate and allergen information before you publish it. A draft made from a photo is a starting point: you check and correct it before guests see it.
    • Keep staff PINs and your login private.
    • Provide power and an internet connection at your counter.
    • Follow the laws that apply to your business.

You may not: copy, resell or reverse-engineer our software; use it for anything unlawful; upload content you have no right to use; try to break, overload or get around its security; or use it to harm guests or others.

  8. 8.Your content

Your menu, photos, logo and other material stay yours. You allow us to store, process and show them as needed to provide the service, including sending menu photos to our recognition provider to draft your menu.

  9. 9.Availability and no guarantee of results

We work to keep the service running, but we provide it "as is" and "as available". It depends on the internet, your equipment and other companies, and it may stop for maintenance or outages. We do not promise any result for your business, such as more sales or more reviews.

Except for the hardware warranty above, we give no other warranties, express or implied, to the extent the law allows.

  10. 10.Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or for lost profits, revenue or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

You agree to cover our losses from claims made by your guests or others about your menu, your products, your prices or your use of the service, and from your obligations to Stripe.

  11. 11.Ending the service

You can cancel at any time by writing to hello@niktrix.org. We may suspend or end the service if you do not pay, break these Terms, misuse the service, or if continuing would break the law. When the service ends, your access ends, and you return any hardware we lent you.

  12. 12.Changes to these Terms

We may update these Terms. We post the new version here with a new date. If a change matters to venues, we tell you by email before it takes effect. Using the service after that means you accept the new Terms.

  13. 13.Law and courts

These Terms are governed by the laws of the State of Florida. Any dispute goes to the state or federal courts located in Miami-Dade County, Florida.

  14. 14.For guests ordering on a kiosk

When you order on a Niktrix kiosk, you are ordering from the venue, not from Niktrix. The venue sets the prices, makes your order and takes your payment. For questions about an order, a refund or a payment, please ask the venue’s staff. We do not ask you for your name, phone number or email when you order.
